1. Introduction

Welcome to ComfyUI Marketplace, a platform operated by Inhype Live Limited ("we," "us," or "our"), a company incorporated in the United Kingdom. These Terms and Conditions ("Terms") govern your access to and use of the ComfyUI Marketplace website and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

ComfyUI Configs: Refers to the JSON format configurations for ComfyUI, a web-based Stable Diffusion interface optimized for workflow customization.

Seller: Any user who offers ComfyUI Configs for sale on the Service.

Buyer: Any user who purchases ComfyUI Configs through the Service.

User: Refers to both Sellers and Buyers.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.

4. Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. Marketplace Operations

5.1. ComfyUI Marketplace acts solely as a venue for Sellers to offer and Buyers to purchase ComfyUI Configs. We are not a party to any transaction between Sellers and Buyers.

5.2. All payments are processed through our platform using Stripe Connect and Stripe Payments. We collect the full payment from Buyers and distribute the proceeds to Sellers, minus our 10% commission and any applicable Stripe fees.

5.3. Sellers may only register from countries allowed by Stripe Connect. Buyers are not subject to geographical limitations.

6. Seller Obligations

6.1. Sellers retain ownership of their intellectual property rights in the ComfyUI Configs they sell. By listing a config for sale, Sellers grant Buyers a limited, non-exclusive license to use the purchased config for personal use.

6.2. Sellers are responsible for ensuring their configs do not violate any existing laws or infringe on any third-party rights.

6.3. Sellers may choose, at their discretion, to provide support or updates for their configs. There is no obligation to do so unless explicitly stated in the config's description.

6.4. Sellers must accurately describe their configs and disclose any limitations or specific requirements.

7. Buyer Rights and Responsibilities

7.1. Buyers receive a limited, non-exclusive license to use purchased configs for personal use.

7.2. Buyers are responsible for reviewing and complying with any applicable laws or regulations regarding AI-generated content in their jurisdiction.

7.3. Buyers acknowledge that the marketplace is not responsible for the output generated by these configs.

8. Prohibited Content

Users are prohibited from selling, purchasing, or using configs that:

• 8.1. Violate any applicable laws or regulations.
• 8.2. Infringe on intellectual property rights of others.
• 8.3. Contain malicious code or are intended to cause harm to computer systems.
• 8.4. Are designed to generate illegal or offensive content.

9. Ratings and Reviews

9.1. The Service includes a rating and review system for configs. Users agree to provide honest and fair ratings and reviews.

9.2. We reserve the right to remove ratings or reviews that we determine to be fraudulent, abusive, or otherwise inappropriate.

10. Refunds and Disputes

10.1. Refunds will only be issued in cases of fraud or if the config is not working as intended.

10.2. Buyers may initiate a dispute if they believe a config does not meet the stated description or functionality.

10.3. Sellers must respond to disputes within 30 days.

10.4. If a dispute is not resolved between the Seller and Buyer, ComfyUI Marketplace will make a final decision on the dispute.

11. Account Termination

11.1. We reserve the right to terminate or suspend any user account for violations of these Terms or for any other reason at our sole discretion.

11.2. In the event of account termination, we will retain necessary data for 90 days to resolve any outstanding transactions or disputes.

11.3. Funds from completed sales prior to termination will be paid out, minus any amounts needed to cover refunds or dispute resolutions.

12. Intellectual Property

12.1. The ComfyUI Marketplace name, logo, and branding are our intellectual property. Users may state that they sell on our platform but may not use our branding in a way that implies endorsement or official partnership without our explicit permission.

12.2. We reserve the right to revoke permission to use our name or branding at any time.

13. Limitation of Liability

13.1. ComfyUI Marketplace is provided "as is" without any warranties, express or implied.

13.2. We are not responsible for the quality, safety, or legality of configs sold on the platform, nor for the accuracy of listings or user content.

13.3. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

14. Privacy and Data Protection

14.1. Our collection and use of personal information in connection with the Service is as described in our Privacy Policy.

14.2. We comply with GDPR and other applicable data protection laws. Users have the right to request deletion of their account and personal information.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
